Its the Constitution Stupid

Am I the only one to notice that the Obama administration is having one hell of a time understanding what is lawful and what is not? Allow me to provide you several examples.

Exhibit A, the drilling moratorium enacted by Interior Secretary Ken Salazar. As you may recall, that moratorium was not struck down once, but twice. I've blogged about this previously, but there was yet another article in the WSJ today on the matter.

Exhibit B, Obamacare. It too has now been struck down twice as unconstitutional. First U.S. District Court Judge Henry Hudson struck down the "individual mandate" requiring most Americans to purchase health insurance by 2014. Then a month later it was ruled unconstitutional AGAIN in Florida, this time by U.S. District Judge Robert Vinson.

And exhibit C, President Obama told the Justice Department this week to no longer defend the DOMA law. In a Newsmax article today Newt Gingrich explains just how this is in essence a dereliction of duty. Not only that, but Obama is breaking the oath he swore to uphold by unilaterally decided which laws to enforce and which one's to pass on.

Now, about these idiots staying away from the state capitol... is there anything that is more un-democratic? I was asked how this is any different than a filibuster. Well, there is a big difference if you ask me. In order to filibuster you still have to show up for work. These jerks are fleeing the state like a bunch of whiny brats. And its now not limited to just Wisconsin Democrats as now Indiana Democrats are fleeing as well.

Hello? Anyone Home McFly?

Is it just me, or is it becoming clear that the Obama administration has little to no clue what is entailed in the Constitution or how the legal system works. We have 3 stark examples in just the first two years of this administration:
  1. President Obama directing the Justice Dept to try Khalid Sheik Muhammed in a NYC courtroom. That didn't pan out for obvious reasons, you cannot try a terrorist in a civilian court without having a circus. And when you, do you end up with these results, a terrorist getting acquitted on 224 out of 225 charges.
  2. ObamaCare. In the last 2 months this lynchpin legislation has been struck down as unconstitutional... twice! Once in Virginia, now again this week in Florida.
  3. The drilling moratorium in the Gulf of Mexico. It was ruled again this week that the Obama administration was in contempt of court in imposing these unwarranted restrictions even after the court struck them down.

Newt, Global Warming, and ObamaCare

This my friends, is just one of the reasons why I've lost a lot of respect for Newt:

In light of the recent monster storm that pounded the midwest, dropping 24"+ of snow in places like Chicago, our good friend Al attributed it all to global warming. Interesting, considering they also predictied global warming would reduce snowfall.

And last but not least, a couple of articles on the state of government and the US District Court striking down ObamaCare as un-Constitutional.
